One of the core principles we hold at Elite Meds is to provide you with the highest quality of healthcare possible. In order for us to do this, we must keep clear records about you, your personal health, and the care we have provided or plan to provide you. We understand the importance and value of your privacy and we take the utmost care in securing your personal information.

This Policy outlines the information we collect about the visitors to our website and explains how we use it. We may change this Policy from time to time so please check this page occasionally to ensure that you’re happy with any changes. This policy is effective from 1st July 2022.


Consent

By using our website, you’re agreeing to be bound by this Policy. When the legal basis for us processing your personal data is that you have provided your consent to that processing, you may withdraw your consent at any time. If you withdraw your consent, it will not make any previous processing unlawful.

What personal data we collect

As part of providing a professional, safe and efficient service, there is certain information that we must record.

Information recorded may include:

  • basic details about you, such as your name, address, gender, date of birth;
  • more in-depth information such as your height, weight and blood pressure;
  • records of medicines you have been prescribed by an Elite Med’s prescriber, and which have been supplied by our pharmacy;
  • details of medicines purchased from our pharmacy without a prescription (“over the counter” and “pharmacy” medicines);
  • other details and notes about your health including any previous (and/or current) health conditions and medical treatments;
  • information relevant to your continued care from other people who care for you and know you well, such as other health professionals (your GP); and any other services we provide to you, for example, diagnostic testing.

Account and orders

There is no ‘guest’ checkout on our website. When you register for an account, we manually collect your name, email address, home address, phone number, date of birth, gender and your password. We keep your password so we can help you log into your account later if you ever forget your credentials. If an order is placed, we also take your payment details and will ask you for a delivery address. We need all this information to process your order and keep you updated about the progress.

We also keep a record of your purchase history, which allows us to improve our products and services and personalise any promotional content, should you opt into receiving it. Data that is collected automatically will include your I.P address and location.


Processing information

We process your personal data for the purposes of:

  • Your care: providing pharmacy and prescribing services to you and helping us maintain an excellent level of care. Where appropriate, we will share your information with your GP (where consent has been provided);
  • Our payments: although we don’t store your card details, we may use your payment information for fraud prevention. The card information is collected by our third-party payment processor, who specialise in the secure online capture and processing of credit/debit card transactions;
  •  Management: we collect personal data to help improve customer experience on our website. Understanding customer data allows us to improve our website functionality as well as helping us create more customised promotions and offers towards our customers. Additionally, we may use your personal information to ensure any enquiries are responded to effectively;
  •  Deliveries: we will provide your address and contact details to our delivery agents in accordance with service agreements.

The length of time we hold your information depends on the exact information that has been gathered. If we supply you with a prescription-only medicine we are required to keep records of this supply for 10 years after your death. This is often the longest period that any data is stored.

A pharmacist is responsible for the confidentiality of your information. All our staff contracts of employment contain a requirement to keep patient information confidential and they are regularly trained on confidentially.

We may pass your information to our third-party service providers and other associated organisations for the purposes of completing tasks and providing services to you on our behalf. We will not sell or rent your information to third parties, nor will we share your information with third parties for marketing purposes.

We may use your personal information to send you promotional content which we think you may find interesting if you tell us that you wish for this to happen. If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time following the unsubscribe/opt-out links provided in all communications from us. Alternatively, you can do this by emailing us at [email protected]

You may request details of personal information which we hold about you under the GDPR. If you would like a copy of the information held on you please email us at [email protected] or write to our Data Protection Officer.

If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible. We will promptly correct any information found to be incorrect.


Identity checking

Elite Meds is obligated by our regulator to ensure that our customers are genuine. To do this we have to conduct identity checks for certain medicines, namely prescription-only medicines and those medicines that have the potential to be abused. Our identity checking is conducted within the checkout by an external company Onfido.

An identity check is to verify the identity of a customer. For example, we may ask for an image, an image of an identity document (e.g. a passport or a drivers license), a picture (at times, taken in quick succession for anti-fraud purposes), or a video of your face. This enables Onfido to verify a customer and allows us to prescribe and send medications to the correct patients.

It is important we make clear that these identity checks do not affect your credit rating. Onfido leaves an identity generic footprint, otherwise known as a ‘soft footprint’ that is not visible to lenders.

Lawful basis for processing

Elite Meds meet high data protection and security standards, therefore any personal data provided is kept safe and secure. Any data that may be collected through our website is processed in a legal manner that does not infringe the rights of our users. We lawfully process your personal data in the performance of a task in the public interest for the provision of healthcare and treatment; this is outlined within:

  • Article 6(1)(e) of the GDPR. “Necessary for the performance of a task in the public interest”;
  • Article 9(2)(h) of the GDPR (including the Data Protection Act). “The provision of health care or treatment” or “the management of health care systems or services or social care systems or services” or “necessary for reasons of public health in the area of public health”.

Your rights

You have the right to confidentiality under the General Data Protection Regulation (and the Data Protection Act 2018) and the common law duty of confidence. Additionally, pharmacists have a requirement under their professional standards to keep records about you confidential, secure and accurate.

Users have the right to request the erasure of personal data from Elite Meds. Under GDPR, this is known as ‘the right to be forgotten’. Any user who has provided personal data to Elite Meds can have it removed without undue delay (considered to be about a month). This right only applies to data held at the time of the request. It does not apply to data that may be created in the future.

You have the right to request any personal data we have collected on you. Elite Meds has an organised and secure system that stores personal data, therefore any personal data requested by a user will be provided in a safe, structured and machine-readable format that can easily be transmitted. This data can also be sent to other companies/organisations that have been designated by yourself. If we provide this information directly to yourself or to another organisation, we are not responsible for any subsequent processing conducted by yourself or the other organisation.


Your right to view your health record

You have the right to ask for a copy of all pharmacy records and health information we hold about you (in paper or electronic form). We’re required to respond to any request within one month and usually there will be no charge for this information.

You will need to give adequate information in order for pharmacy staff to identify you (for example, full name, address and date of birth). You will also be required to provide government issued ID, for example a passport/driving license, before any information is released to you.

If you believe that any health information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible. We will promptly correct any information found to be incorrect.

You may object to us holding your information; you have the right to request the restriction or suppression of your personal data including your health records. This is not an absolute right and only applies in certain circumstances. When processing is restricted, we are permitted to store any personal data, but not to use it.


Marketing

When you agree to receiving marketing from us using a sign-up page or checking the “Email” or “SMS” box, we will save your contact details (email address and/or phone number) together with your communication preferences and only send you marketing via your chosen channel – email and/or SMS.

We will periodically send you promotional emails/SMS about new products, special offers or other events, which we think you may find interesting. Should you wish to stop receiving those updates, you can easily unsubscribe from them following the unsubscribe/opt-out links provided in every communication we send you.


Data security

We are committed to ensuring that all data we collect is gathered, stored and processed in accordance with the GDPR. To prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we hold on you.

We will not sell or rent your information to third parties, nor will we share your information with third parties for marketing purposes.

Whilst we take all reasonable precautions to ensure that user data is secure and that you are protected, there always remains the risk of harm. The Internet can be insecure at times and therefore we are unable to guarantee the security of user data beyond what is reasonably practical.
