Sale of Goods
These Terms and Conditions govern the sale of goods available on our site. We are under a legal duty to supply products and goods that match the description of the item(s) on our website. All information, descriptions, or images that we provide about our goods are as accurate as possible.
We reserve the right to modify, reject or cancel your order whenever it is deemed necessary for the safe supply of medicines. This is a legal obligation of being a registered pharmacy in England and the final decision is always with the Responsible Pharmacist that is on duty on a specific date.
The ‘generic’ medicine images on our products are for display and product purposes only. We are under no obligation to supply you with the ‘generic’ medicine that is in the product image (made by a specific manufacturer). Where there is no obligation on our part we have categorised the ‘Brand’ on our website as ‘Elite Meds Generic’ to avoid confusion. The pharmaceutical supply chain in the U.K is complex and dynamic (with wholesale prices often fluctuating daily), our aim is to offer the cheapest prices possible to our customers and this is only possible if we have this approach to ‘generic’ medicines.
Governing Law and Jurisdiction
These Terms and Conditions and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
Consumer Protection Law
Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.
Payment for the goods and delivery charges can be made by any method shown on the website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle the us to terminate the contract immediately.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
You must not use our website in any way that may cause access to it to be intermittent or impaired at all. Please remember that you are solely responsible for all electronic communications and content sent by you to us.
Our website must not be used for any fraudulent or unlawful activities. We do everything we can to ensure your account is protected. Please be aware that your account is your responsibility, and by using this site, you are accountable for all activities that occur under your account.
You are solely responsible for keeping your username and password confidential and for ensuring that they are not used by any other person. If you have any reason to believe that unauthorised usage of your account may have occurred, you should contact us immediately.
You have read the key facts provided about each service and agree that we have provided sufficient information for you to make an informed decision as to whether this service is appropriate for your situation.
You will only provide information that is true and complete to the best of your knowledge when completing medical assessments, during email exchanges and online consultations. No information should be withheld that may be relevant to a doctor's decision to prescribe a medicine. Any intentionally incorrect information provided by yourself during a consultation process will be viewed as illegal.
You will not complete a questionnaire if you do not understand the questions.
You will not create more than one account to obtain treatment for anyone else apart from yourself, and any treatment obtained will be for your sole use. You will not intentionally create more than one account per household, in a different name, in the attempt to receive inappropriate quantities of medication.
Privacy and Data Protection
Elite Meds complies with Data Protection legislation. We will use the information you provide with other information we obtain about you to administer and provide the goods and/or services you request. We will not share your personal information with any organisation other than those directly involved in delivering these services, namely our physical dispensing pharmacy and the courier service.
If we are requested to do so by law, we will share your data with HM Revenue & Customs, regulators and other authorities and law enforcement bodies to assist an investigation, identity verification, debt recovery and the prevention of fraud.
Users may post medication reviews on our website. By posting publicly on our website, you agree for the review to be genuine and not to act illegally or violate these Terms and Conditions.
When you purchase goods from the website, the goods will be delivered via one of the methods on the ‘Delivery and Return’ page. You will be required to pay delivery charges as outlined in addition to the price of the goods purchased.
Orders placed before 3:30 pm on a working day will be processed that day and will be delivered as per the requested delivery option provided no additional security checks are required and all stock items are available. (A working day is any day other than weekends and bank or other public holidays.)
If delivery cannot be made to your address for reasons under our control, we will inform you as soon as possible.
Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, we will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, we will inform you of any delay as soon as possible and will give you the option of cancelling your order at this point.
The goods are at your risk from the time of delivery. Ownership of the goods shall not pass to you until we have received in full (in cash or cleared funds) all sums due to it in respect of those goods.
We have taken every care in the preparation of the content of this website, however, we cannot guarantee uninterrupted and reliable access to this website, and so, therefore, cannot guarantee that the information will always be completely up to date and free of mistakes. To the extent permitted by applicable law, we disclaim all warranties; express or implied, as to the accuracy of the information contained in any of the materials on this website and will accept no liability for any loss or damage arising because of problems with access.
We shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials on this website.
Certain links, images and assets in this site may lead to other websites which are not under our control. When you activate any of these you will leave the Elite Meds website, we have no control on these websites and will accept no responsibility or liability for the material on them.
When you place an order for medicines or request a service that involves the prescribing of medicines, this will require us to assess your clinical suitability for the medicines before the medicines can be approved for supply. You agree to us commencing this service and an assessment of your clinical suitability when you place the order and, as such if you cancel your order once the prescription has been issued you will be liable for a prescription fee (£2.50) but refunded the full cost of the medicine and delivery costs.
When we receive a prescription for you, we will verify it against the information provided to us at the time the order was placed. If the information does not match with your original order, we may try to contact you using the contact information in your registration. If we cannot contact you and we are unable to dispense the item(s) on your Prescription Order your order will be placed on hold.
We only accept Prescription Orders from customers who are 18 years old or over although they may order prescriptions for persons who are under 18. By placing an order, you confirm that you are at least 18.
Products and Pricing
We only source and use medicines that have been licensed for use in the UK. We only buy medicines directly from either the manufacturer or from an authenticated UK licensed wholesaler.
All prices on this website are in GBP and include VAT unless expressly stated otherwise. We take care to ensure that all pricing information on our website is accurate but occasionally there may be an error. In the event that an error has occurred and the price charged is too high, we will identify all those that have overpaid and refund the difference.
Promotional codes can be used once only per customer as defined by their email address and/or credit card address and/or delivery address. Only one promotional code can be used per transaction. Offers cannot be used in conjunction with certain other offers.
Promotional codes offering a discount when you spend a certain amount can only apply to a single transaction and may exclude certain items. Please note that promotional codes also have an expiry date, after which they are not redeemable.
When placing an order, we validate your order and the payment details you submit to us before your order can be accepted. Once that has been done, we will acknowledge that your order has been received by sending an email to the email address you provide in your registration form.
Your order is then subject to further validation checks we may choose to make. It is also passed to a prescriber for a clinical analysis. If your order passes the subsequent validation checks we will send you an order confirmation email, this is our acceptance of your order and once despatched brings into existence a legally binding agreement between us.
Orders containing a ‘Prescription Only’ or ‘Pharmacy medicines’ will always be subject to a final review by the Responsible Pharmacist on duty. Subject to this pharmacist's approval, the sale of these medicines will then be made by us
We reserves the right to restrict the number of items available for sale to any individual customer. All orders are subject to availability. If any items are not available and you paid using a debit/credit card you will not be charged for the cancelled items.
We hope you will be happy with any items you’ve ordered from us, but if you’re not entirely satisfied, you’ll find details of our returns policy here and below.
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations give you 28 calendar days from the date you received or collected your complete order to notify us of items you are not completely happy with. We must receive any item you return to us within 28 calendar days of your notification to us of your intention to return the item(s). Orders cancelled under these Regulations are entitled to a refund of any standard postage paid for the delivery of your order, but you are responsible for any postage incurred in returning the items you wish to cancel to us. Unfortunately, we do not refund postage on the return of part orders.
Items must be returned in the condition you received them, which includes keeping any hygiene seals in place. You will lose your right to return an item if you unseal a product that needs to be sealed for health or hygiene reasons.
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations give us the right to reduce the amount of refund that you receive if non-faulty items being returned are damaged or used in any way. The amount which we might reduce your refund by will be dependent on the decrease in value of your use of the item. You should also be aware that should your use mean that your item(s) cannot be resold, this reduction may be 100%.
